Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of DontSell (“DontSell,” “we,” “us,” or “our”), including the website, app, and related services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization, and “you” refers to that organization. If you do not agree, do not use the Service.

DontSell is an assistive outbound co-pilot. It helps you research prospects, draft personalized messages in your voice, and manage replies — with a human approval step and built-in sending safeguards (rate limiting, a do-not-contact list, and an emergency stop). DontSell is a tool that acts under your direction; you remain the sender and are responsible for the outreach you approve and send.

You must be at least 18 years old and able to form a binding contract to use the Service. During the pilot, access is invite-only. You agree to provide accurate information, to keep your credentials secure, and to be responsible for all activity under your account. Notify us promptly of any unauthorized use.

You agree that you will not, and will not permit anyone to:

• use the Service to send unsolicited bulk messages, spam, or content that is unlawful, deceptive, harassing, hateful, or infringing;
• violate the terms, policies, or acceptable-use rules of any third-party platform you connect (including LinkedIn and any messaging provider), or attempt to evade their automation, rate, or anti-abuse controls;
• contact people without a lawful basis to do so, or in violation of applicable marketing, anti-spam, or data-protection laws;
• upload data you do not have the right to use, or personal data of anyone who has asked not to be contacted;
• reverse engineer, resell, or misuse the Service, or interfere with its security or integrity.

You are solely responsible for the messages you approve and send and for your compliance with all laws and platform rules that apply to your outreach.

You retain all rights to the leads, messages, and other content you provide or generate through the Service (“Your Content”). You grant us a limited, non-exclusive license to host, process, and transmit Your Content solely to operate and improve the Service for you, including sending it to the third-party providers described below. We do not sell Your Content, and we do not use your prospect data to train models for other customers.

The Service integrates third-party providers — for example, LinkedIn access via a messaging provider, AI drafting, payment processing, hosting, and background job execution. Your use of those integrations may be subject to the third party’s own terms, and we are not responsible for their acts or omissions. See our Privacy Policy for the current list of sub-processors.

Paid plans, prices, and any free trial are described on our pricing page. Payments are processed by our payment provider; by starting a paid plan you authorize recurring charges until you cancel. You can cancel before a trial ends to avoid being charged. Except where required by law, fees are non-refundable. We may change prices on prospective notice.

You represent and warrant that you have a lawful basis to contact each recipient and that your outreach complies with all applicable laws and platform policies, including data- protection laws (such as the GDPR and UK GDPR) and anti-spam laws (such as CAN-SPAM and CASL). You will honor opt-out and do-not-contact requests promptly. DontSell’s safeguards assist compliance but do not guarantee it, and using them does not shift responsibility for your outreach to us.

The Service, including its software, design, and content (excluding Your Content), is owned by DontSell and its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms. All rights not expressly granted are reserved.

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that AI-generated drafts will be accurate or appropriate, or that outreach will produce any particular result. Nothing in the Service is legal advice.

To the maximum extent permitted by law, DontSell and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability arising out of or relating to the Service will not exceed the amounts you paid us for the Service in the twelve months before the event giving rise to the claim (or, if you have paid nothing, one hundred US dollars). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

You agree to indemnify and hold harmless DontSell and its personnel from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, your outreach, or your violation of these Terms or of any law or third-party right.

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required for security or legal reasons, or if we discontinue the Service. Upon termination, your right to use the Service ends; sections that by their nature should survive (such as ownership, disclaimers, limitation of liability, and indemnification) will survive.

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the jurisdiction in which DontSell is established, without regard to conflict-of-laws rules, and the courts of that jurisdiction will have exclusive jurisdiction, except where mandatory local law provides otherwise.
